RACs Are Delayed: Your Exposure Is Not
On Monday, November 3, 2008, The Centers for Medicare & Medicaid Services announced a delay in the national, permanent RAC implementation due to a protest filed by two vendors who were not selected as part of the permanent RAC program.
CMS issued a statement stating that it is postponing all activity involving the four permanent Medicare recovery audit contractors due to a “RAC protest and stay of performance.” Provider education “outreach” sessions that had been scheduled through December 2008 have been delayed until further notice.
The protests were filed with the GAO by vendors who were not selected as RACs have protested the selection process. The progress of the protests can be tracked on the GAO website: http://www.gao.gov/decision/docket.
As of now, the hearing dates for the appeals are Feb. 9 and Feb. 11. Although CMS has already delivered provider data to the RACs, there cannot be a resumption of RAC activity until the adjudication of the hearings (unless the parties drop their bid protests).
CBIZ KA Consulting Services, LLC (CBIZ) advises providers to continue their RAC preparation efforts. This delay does not constitute a suspension of RAC services but merely an appeal for vendor selection. The RAC program will continue.
Another factor to consider is that the look-back period for the RAC remains Oct 1, 2007; hospitals that delay their preparation will face significant challenges in effectively mitigating their RAC risk and reviewing their at-risk cases
